Terms and conditions of sale
These general terms and conditions of sale, hereinafter referred to as the "GTCS", apply to all orders placed on the Internet site www.motoblouz.com, hereinafter referred to as the "Site", published by D3T DISTRIBUTION, hereinafter referred to as "MOTOBLOUZ", a simplified joint stock company with a capital of 9.195,00 €uros, registered with the R.C.S. of Arras under number 478 566 250, having its registered office at 72 rue Elie Cartan, zone artisanale de la Gare d'Eau 62220 CARVIN, represented by Mr Jérôme Dalidet.
The General Terms and Conditions of Sale are made available to Internet users, whether visitors or Customers, on the Site, where they can be consulted directly, and can also be communicated to them on request by any means.
By registering on the Site, the Customer confirms that he/she has read and accepted the GCS, thereby becoming contractually bound by their terms.
MOTOBLOUZ reserves the right to adapt or modify the GTC at any time. In the event of modification, the GTC in force on the day of the order will be applied to each order.
MOTOBLOUZ reserves the right to modify at any time and without notice the content of the Site or the services available on it, and/or to cease temporarily or permanently to operate all or part of the Site.
Compliance with Extended Producer Responsibility (EPR) :
In accordance with the French anti-waste law for a circular economy (Loi AGEC), Motoblouz (D3T Distribution) is a member of various eco-organizations.
Our unique identification numbers (IDU) are :

All offers of products, services and delivery terms, at the prices indicated in Euros, are valid in continental France within the limits of available stocks.
For orders from the European Union, the VAT rate applied is the same as for France. You will simply have to pay additional shipping costs, which will be indicated when you choose your delivery method.
For orders from abroad or from French overseas departments and territories, the products will be invoiced tax-free and you will have to pay shipping costs calculated according to the destination country and the weight of the parcel. Upon receipt of the parcel, you will be required to pay customs duties and local VAT according to the country of destination. The cost of shipping will be indicated when you select your delivery method.

A description with the essential characteristics of the product is present on each item we sell. However, slight variations may occur, so please contact our customer service department in case of doubt.
The photographs illustrating the products and their description do not constitute a contractual document.
Our teams do their utmost to render a faithful image of the products offered for sale through the images or photographs used for their presentation. Nevertheless, variations may appear, notably due to technical limitations, color rendering or customer equipment (Internet browser, screen used). Motoblouz therefore recommends that the customer refer to the product description on the site for the essential characteristics.
Except in the case of a warranty (see article 10 below), any transaction between Motoblouz.com and its customers, not contested within 14 days of delivery, may not give rise to a claim.
To place an order on the Site, the Customer must first create a personal customer account. Once created, to access the account, the Customer must identify himself using his personal and confidential login and password.
Each Customer undertakes to maintain strict confidentiality with regard to the data, in particular the login and password, enabling him/her to access his/her customer area. The Customer acknowledges that he/she alone is responsible for accessing the service using his/her login and password, unless fraud has been proven.
Customers also undertake to inform MOTOBLOUZ immediately in the event of loss, misappropriation or fraudulent use of their login and/or password.
After creating his personal customer area, the Customer will receive an email confirming the creation of his customer area.
When registering, the Customer undertakes to :
- provide true, accurate and up-to-date information at the time it is entered in the service registration form, and in particular not to use false names or addresses, or unauthorized names or addresses;
- keep registration data up to date, so as to ensure that it is real, accurate and up-to-date at all times.
The Customer further undertakes not to make available or distribute any illegal or objectionable information (such as information constituting identity theft) or harmful information (such as viruses). Should this not be the case, MOTOBLOUZ may suspend the Customer's access to the Site at its sole discretion.
The Customer acknowledges that the characteristics and constraints of the Internet make it impossible to guarantee the security, availability and integrity of data transmissions over the Internet.
MOTOBLOUZ therefore does not guarantee that the Site and its services will operate without interruption or malfunction. In particular, its operation may be temporarily interrupted for maintenance, updates or technical improvements, or to change the content and/or presentation.
MOTOBLOUZ may not be held liable for the use of the Site and its services by Customers in breach of these GTC and for any direct or indirect damage that such use may cause to a Customer or third party.
In particular, MOTOBLOUZ cannot be held responsible for false declarations made by a Customer.
In the event that MOTOBLOUZ is held liable for such a fault on the part of one of its Customers, the latter undertakes to hold MOTOBLOUZ harmless against any judgement pronounced against it and to reimburse MOTOBLOUZ for all costs, in particular representation costs, incurred in asserting its rights before the Courts.
An order can only be registered on the site if you have clearly identified yourself, either by entering your login and password, which are strictly personal to you, or by creating an account on the www.motoblouz.com website if you are not yet registered.
Any order implies acceptance of the prices and description of the products available for sale. The contract is formed when your order is confirmed.
Once your order has been confirmed, it will be sent to our logistics department for processing. Within the hour, you will receive an automatic e-mail acknowledging receipt of your order.
We remind you that confirming an order implies the obligation to pay the price indicated.

Prices are quoted in euros (€) and include the applicable French VAT.
In the event of a promotion, MOTOBLOUZ undertakes to apply the promotional price to all orders placed during the period covering the promotion.
The price is payable in full once the order has been confirmed, with the exception of the payment option of 3 instalments free of charge detailed in article 6.5 below. The prices shown include any discounts and rebates that MOTOBLOUZ may offer.
If delivery or transport charges apply (see article 7 below), they will be added to the order price and indicated separately before the order is validated by the Customer. The total amount due by the Customer and its details are indicated on the confirmation page of each order.
In the event of a partial return of your order including products eligible for a promotional code, the amount of the discount is automatically adjusted according to the conditions of the code. Example: I ordered a product worth €100 with a -10% discount and a product worth €300 with a -20% discount. My total order is €400, but I'm entitled to a €70 discount, broken down as follows: €10 for the €100 product (-10%) and €60 for the €300 product (-20%). I decide to return the €300 product. I will therefore receive a refund of 240€, which corresponds to the value of the 300€ product minus the 60€ discount linked to the promotional code.
In the event of a complete return of your order, the amount of the discount linked to the promotional code will be cancelled.
6.1 BY CREDIT CARD
Payment is made on our secure payment interface for orders placed on motoblouz.com, and also on our electronic payment terminal for orders placed in the Motoblouz Shop. This means that no banking information can be misappropriated by a third party. Payment by credit card is therefore perfectly secure. Motoblouz.com certifies that it does not hold any banking information entered during the ordering process. All bank details are transmitted in real time to our partner Hipay. For purchases made on the web, as your account is debited when your order is prepared, Hipay provides us with a pre-authorized debit, valid for 6 days. If shipment takes place after these 6 days, your account may be debited again. In-store purchases are debited immediately.
Payment security : Your credit card details are encrypted using the TLS(Transport Layer Security) protocol, and are never transmitted unencrypted over the network. Payment is made directly to the bank. Motoblouz.com has no access to these details, and does not store them on its servers. That's why you'll be asked for them again each time you make a new transaction on our site.
6.2 VIA PAYPAL
Your payments are made directly on the PayPal site via encrypted pages using the TLS (Transport Layer Security) protocol. Motoblouz.com has no access whatsoever to your bank details.
6.3 VIA APPLE PAY
Simply authenticate yourself with Face ID, Touch ID or your access code. Apple Pay uses a number specific to your device and a unique transaction code. Motoblouz.com has no access to your bank details.

IMPORTANT: for payments in 10x, an additional verification system may be required to guarantee the security and acceptance of your financing. You will need to select your bank and enter your login details. This procedure is 100% secure to guarantee the protection of your data.
6.4.2 Special conditions for payment in instalments
FLOA
Motoblouz.com offers you its payment facility to pay in 3 instalments by credit card from a purchase of €50. This service is available on motoblouz.com. The total amount of the order will be divided into 3 monthly payments. The first instalment will be debited upon validation of the order and payment. Subsequent instalments will be debited every 30 days from the date of the 1st instalment. Valid for Metropolitan France and overseas territories.
This financing service is provided by our partner FLOA. If you wish to subscribe to this service, your details will be forwarded to FLOA who, subject to acceptance of your application, will provide you with a payment schedule showing the various monthly instalments.
As soon as your order has been confirmed, you will pay the 1st monthly instalment clearly displayed. You will then be debited for the remaining instalments according to the payment schedule you have been given.
For all purchases over the minimum purchase amounts (see table above) made in France (including Corsica and French overseas departments and territories), customers can pay for their order in 4 or 10 instalments with FLOA. When paying for your order, choose "Pay from 4x to 10x". This financing service is provided by our partner FLOA. If you wish to subscribe to this service, your details will be forwarded to FLOA, who, subject to acceptance of your application, will provide you with a payment schedule summarizing the different monthly instalments.
As soon as your order has been confirmed, you will pay the 1st monthly instalment plus the financing charges clearly displayed (smoothed over all your monthly instalments). You will then be debited for the remaining instalments according to the payment schedule you have been given.
Payment in 3x, 4x by credit card with our partner FLOA
Our financial partner FLOA, offers payment solutions for your purchases of goods and/or services, in deferred, 3 or 4 instalments by credit card. These payment solutions are reserved for individuals (natural persons of legal age) residing in France, holding a Visa or MasterCard bank card with a validity date corresponding to the duration of the repayment. PAYPAL 4X
Your payments are made directly on the PayPal site via encrypted pages using the TLS (Transport Layer Security) protocol. Motoblouz.com has no access whatsoever to your bank details.
All you have to do is select Paypal when making your payment. Once connected to the Paypal server, scroll down and select payment in 4 instalments. The amount of the 4 instalments and the fees are clearly displayed on the screen. As with conventional Paypal payment, the transaction is perfectly secure and Motoblouz.com has no knowledge of your bank details.

6.5.2 Special conditions for deferred payment
For all purchases over the minimum purchase amount (see table above) made in France (including Corsica and French overseas departments and territories), the customer has the option of paying 15 days or 30 days after the purchase with FLOA. When paying for your order, choose deferred payment (in 15 or 30 days). This financing service is provided by our partner FLOA. If you wish to subscribe to this service, your details will be forwarded to FLOA who, subject to acceptance of your application, will provide you with a payment schedule showing the various monthly instalments.
Once your order has been validated, you will pay the amount and the financing charges clearly displayed 15 or 30 days later.
Please note that cards with systematic authorization such as Electron or Maestro, Revolut and Nickel accounts, e-cards, virtual cards, Indigo cards and American Express are not accepted for 15- or 30-day deferred payment.

6.6 BY GIFT CARD
The gift card offers you the assurance of a successful gift every time. It can be used throughout the Motoblouz.com site and is used when you choose your method of payment. It can also be used in our Seclin and Carvin stores.
The use of the gift card to pay for your order can be combined with our current promotional codes. The amount of the gift card can be used in several instalments. The gift card is valid for one year from the date of purchase.
When your order is returned, your gift card is credited to your customer account as a purchase voucher.
The gift card is non-refundable.
ATTENTION: the sale of gift cards on the Motoblouz site is not available to customers residing outside Europe (including French overseas departments and territories).Payment in 3x without charge is not available for the purchase of gift cards. Vouchers cannot be used for the purchase of gift cards.
6.7 BY BANK CHECK
In the case of payment by cheque, your order is reserved for 15 days. After this period, without receipt of your cheque, your order will be cancelled. The order will only be processed on receipt of your cheque and after validation. The announced delivery time may vary according to the time taken to receive your payment.
Payment by cheque is available on our site up to 1500€. Payment for orders over €1,500 is still possible, but please contact customer service on 03.21.43.33.04.
You can also pay for your order in 3 instalments, free of charge, for orders of €150 or more and a maximum value of €1,500. Payment for orders over €1,500 is still possible, but please contact your customer service department on 03.21.43.33.04.
Procedure :
- Date your cheques on the day of purchase.
- Note your order number on the back of each cheque.
- The first cheque will be debited immediately, and the others at monthly intervals.
- If you wish, you can note the debit day of your choice in the month.
6.8 BY BANK TRANSFER
Your order is reserved for 15 days. If we do not receive your bank transfer within this period, your order will be cancelled. The order will only be processed once your bank transfer has been received and validated. The announced delivery time may vary according to the time taken to receive your payment. Payment by bank transfer is available directly on the site up to 1500€. For payments above this amount, please contact our customer service department on 03.21.43.33.04. In the case of payment by bank transfer, any additional charges applied by the issuing bank cannot be deducted from the payment to be received. Each party must bear the transfer charges applied by its bank.
6.9 CASH
When placing an order in the Motoblouz Shop in Carvin or in the Seclin store, you may pay for your order in cash. This method of payment is not available on motoblouz.com.
6.10 PAYMENT BY ILLICADO CARD
It is now possible to pay for all or part of your order with an Illicado gift card.
1. Enter the gift card number on the back of the card (19 digits) in the field provided.
2. After scratching the grey area on the back of the gift card, enter the visual cryptogram in the field provided (3 digits).
It is possible to make a partial payment by Illicado gift card and complete the order by credit card.
In the event of cancellation or return for refund of all or part of the order, your Illicado gift card will be re-credited directly. ATTENTION: Remember to keep your Illicado card. If your Illicado gift card is no longer active, a credit note will be available in your Motoblouz customer account.

6.11 BANCONTACT PAYMENT
It is now possible to pay for all or part of your order with Bancontact.
With Bancontact, you can pay easily, quickly and securely. When validating your order, select the Bancontact payment method and you will be redirected to the Bancontact online portal. Motoblouz.com has no knowledge of your bank details. Payment is made by scanning the QR code with the Bancontact application on your smartphone, or by using your bank card and a digipass. Bancontact payments are debited immediately when the order is placed.
6.12 PAYMENT BY iDEAL
It is now possible to pay for all or part of your order with iDEAL.
With iDEAL, you can pay easily, quickly and securely. When validating your order, select the iDEAL payment method and you will then be redirected to the iDEAL online portal. Motoblouz.com has no knowledge of your bank details. Payment can be made by scanning the QR code with the iDEAL application on your smartphone. The iDEAL payment is debited immediately when the order is placed.
6.13 RESERVATION OF OWNERSHIP CLAUSE
Products remain the property of Motoblouz.com until full payment of the order has been received by Motoblouz.com. However, from the moment of delivery, the risks of the goods delivered are transferred to the customer.
6.14 DEFAULT OF PAYMENT
Motoblouz.com reserves the right to refuse to make a delivery or to honour an order from a consumer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress.
6.15 ANTI-FRAUD CONTROL
The security of your orders on Motoblouz.com is a major concern. This is why orders are checked before shipment.
As part of this control and in order to fight against fraud and usurpation of means of payment on the Internet, Motoblouz may ask the customer to provide proof of identity and residence. Depending on the date of receipt, your order may be delayed. Please note that proof of identity is analyzed and deleted after validation.
If the check of these documents proves favorable, the order will be validated. Otherwise, or in the event of non-receipt, Motoblouz reserves the right to cancel the order. The order will then be cancelled and reimbursed.
6.16 SCEAU DE CONFIANCE Trustpilot
Your purchase on Motoblouz gives you the opportunity to participate in a satisfaction survey organized by Trustpilot.
Through a satisfaction questionnaire designed to measure the quality of service provided to you throughout your purchase, you can share your personal experience with the community on the Trustpilot and Motoblouz.com sites.
Trustpilot will send you this questionnaire by e-mail 7 days after your order has been dispatched.
Trustpilot uses an intelligent customer evaluation service that enables users of e-commerce sites to have full confidence in an Internet transaction. E-tailers can thus openly show what their customers think of their services.
The information gathered in this questionnaire is subject to automated data processing, for which Trustpilot is responsible.
Partial or no answers to this satisfaction questionnaire will not affect the processing of your order.
Trustpilot and Motoblouz are the recipients of the personal data collected in these satisfaction questionnaires.
Non-nominative data will be used by Trustpilot in accordance with current regulations, in particular those concerning the protection of personal data.

7.1 Shipping terms
Motoblouz.com undertakes to respect as far as possible the delivery date given as an indication in the product description, in the basket, in the order summary and in the order confirmation e-mail. A delivery date will also be indicated once you have chosen the delivery method that suits you best.
When ordering several items, the longest delivery time applies. For example, if you order a jacket shipped within 48 hours and a helmet shipped within 7 days, the entire order will be shipped within 7 days.
Packages are dispatched Monday to Friday, excluding public holidays.

When you choose your preferred mode of transport, you will notice that the name of the carrier does not appear at this stage.
Indeed, to ensure the best quality of service, we have decided to work with several carriers for each type of delivery.
In other words, you choose the mode of transport that suits you best, and we decide which carrier is likely to satisfy your request under the best conditions (according to price, quality of service and your delivery location).
You will be informed of the carrier used when your order is dispatched. An e-mail will then be sent to you, giving you the name of the carrier selected, as well as the tracking number for your package.
We work with the following carriers in particular:
Delivery to relay points / consignes (24/7):
Supérettes, newsagents, dry cleaners, florists and Consignes...: relay points are local shops. Consignes are mainly located in high-traffic areas. So you can choose to have your order delivered to a relay point or consigne close to your home or workplace!
As soon as your parcel is deposited in a relay point or consignee, you'll receive an SMS and/or e-mail to inform you. To collect your parcel, you'll need to show proof of identity, and your parcel will then be handed over to you against signature in the relay point. To collect your parcel from a left-luggage office, simply enter the PIN code you received by SMS and/or e-mail and follow the instructions on the left-luggage office screen,
Please note: most of the time, transport companies do not stock their depots on Mondays (as many shops are closed on this day). Consequently, the delivery time indicated (24h or 48h) takes into account the fact that Tuesday to Saturday are working days.
We remind you that you can choose between a 24h or 48h delivery time, depending on your needs.
If the parcel is not collected within 8 calendar days (this period may be subject to change depending on the carrier or the time of year), it will be returned to sender. This period is reduced to 5 days for parcels delivered to lockers.
Home delivery within 48 / 72 working hours:
Deliveries are made from Tuesday to Saturday.
You will receive an e-mail from our carrier, usually the day before delivery, to inform you of the expected delivery date. In order to deliver your parcel, the driver may ask you for the PIN code received by SMS and/or e-mail.
If you are absent at the time of delivery :
- If the size of your parcel allows it, it will be left in your letterbox.
- Otherwise, a delivery notice will be left, inviting you to collect your parcel from a post office or relay point near you.
Delivery to your home or workplace within 24 hours:
Deliveries are made from Monday to Saturday.
On the day your parcel is picked up by the carrier, you will receive an e-mail and/or SMS informing you of the scheduled delivery date. You can then modify the delivery date and/or location on the carrier's website until midnight!On the day of delivery, in the early morning, you will receive an SMS indicating the estimated delivery time (for example: "your parcel will be delivered between 10:20 and 11:20"). In order to deliver your parcel, the driver may ask you for the PIN code received by SMS and/or e-mail.
If delivery cannot be made, the parcel is automatically dropped off at a relay point near your home. Access permitting, you will find a delivery notice in your letterbox. You will also receive a "digital delivery notice" by SMS or e-mail inviting you to go to the designated drop-off point to collect your parcel.
Don't forget to bring proof of identity!
If you are unable to collect your parcel, you can also authorize a person of your choice to do so. This person must be in possession of a letter of authorization signed by you, as well as his or her ID. If the parcel is not collected within 8 calendar days (this period may be subject to change depending on the carrier or the time of year), it will be returned to the sender.
If you choose to have your order delivered to your place of work, it is imperative that you include the company name and the first and last name of the recipient in the delivery address. Without this information, we cannot guarantee delivery to your chosen address.

Click and Collect delivery enables you to order your items on the website, and collect them from our stores:
1. The Motoblouz Shop, located at 72 rue Elie Cartan, 62220 in Carvin.
The Shop is open from Monday to Saturday, 10am to 7pm.
2. The Lille-Seclin store, located Zone Unexpo, Rue de l'Industrie, 59113 Seclin.
The Lille-Seclin store is open Monday from 2pm to 7pm and Tuesday to Saturday from 10am to 7pm.
3. Le Shop Tours - Motors Avenue, located at 15 Avenue du Danemark, 37100 Tours.
Shop Tours is open Monday and Saturday, 9.30am to 12.30pm and 2pm to 6pm. And Tuesday to Friday, 9am to 12:30pm and 2pm to 6:30pm.
You'll receive an e-mail to let you know when you can pick up your order. You will then have 7 days to collect your order in the Shop. If you are not available within this time, please contact Customer Services on 03 21 43 33 04 from Monday to Friday from 9.00 a.m. to 6.30 p.m. and on Saturday from 9.00 a.m. to 12.30 p.m. and from 1.30 p.m. to 5.00 p.m. Don't forget to bring your ID! Deliveries outside France:
For deliveries outside France, delivery charges depend on the destination and will be announced when you place your order.
For transport reasons, some products cannot be shipped to certain countries or to Corsica.
In this case, you will be informed at the delivery stage of your order.
When your order reaches its destination, customs clearance may take 30 days.
7.3 Taxes applied to your orders :
For deliveries within the European Union, French VAT applies to the order and you will not be able to reclaim VAT in your country.
For orders to French Overseas Departments and Territories and outside the European Union, products will be invoiced tax-free and you will be required to pay shipping costs calculated according to the destination country and the weight of the package. Upon receipt of the parcel, you will be required to pay additional customs duties, VAT and other local taxes, depending on the destination country:
- For French overseas departments, you will have to pay local VAT (except Guyana), dock dues and regional dock dues. There are no customs duties.
- For French overseas territories, you will have to pay local VAT (for French overseas territories, only French Polynesia is concerned), and customs duties.
The cost of delivery (excluding duties and taxes applicable in your country) will be indicated to you when you choose your delivery method. For shipments to French overseas departments and territories and outside the EU, we would like to draw your attention to 3 points:
- all duties and taxes are calculated by the customs authorities on the value of the order, including transport;
- if you choose an "express" carrier, they will charge you an additional flat-rate handling fee, corresponding to the fact that they calculate and collect duties and taxes on behalf of the customs authorities, thus saving you time on delivery.
- parcels destined for Switzerland may transit through France (under 2 kgs) or Belgium (over 2 kgs), so the flat-rate customs charges applied may vary.
7.4 Additional information :
No compensation can be claimed if an item cannot be delivered: either due to an unforeseen manufacturing stoppage, or due to strikes, accidents, natural disasters, the impossibility of obtaining supplies or any other causes beyond our control.
Orders cannot be delivered on public holidays.
The return period is 2 years for non-professionals. Returns are free of charge for customers in mainland France and Corsica, Luxembourg and Belgium, but remain the responsibility of customers in other countries and French overseas departments and territories.

7.5 Delivery anomalies
1- A missing product
Check the general condition of your parcel before taking possession of it. The parcel is unopened, the guarantee strip is intact, there is no major damage to the box, the customer accepts the parcel. When the box is delivered, please check if it is damaged, rescotched or if the guarantee strip has been opened. If this is the case, please make a written reservation. The delivery person doesn't have time to note your reservation? Refuse the parcel and contact Mondial Relay first. If it's a Chronopost delivery, refuse the parcel and contact us. Please note that you have 3 working days from the date of delivery to inform us.
If the customer accepts the parcel as is, no recourse can be made against the carrier in the event of need. 2- If your parcel has been delivered but you haven't received it
As soon as the package is indicated as delivered on your tracking number, you have 30 days to file a claim with the carrier. Once this period has elapsed, you have no further recourse against the carrier. - In the case of delivery against a secure PIN code, as this is unique and confidential, no claim will be possible. Never give your PIN code to the delivery person by telephone. - In the case of a delivery with or without a signature, an investigation will be carried out upon receipt of the delivery dispute document completed by hand and accompanied by the claimant's identity document. In the particular case of Colissimo without signature, you must contact the Customer Service department of the addressee's address to file a complaint. We can also intervene with Colissimo after your intervention with the carrier.
For deliveries made by Mondial Relay, in the event of a dispute, the claim must be made to the carrier within 72 working hours. The delivery time indicated in the tracking system is decisive.
After this time, no claim can be made or resolved.
In accordance with Articles L.221-18 et seq. of the French Consumer Code, you have a period of 14 calendar days from receipt of your items to exercise your right of withdrawal without having to give reasons or incur any other costs.
In the case of an order for several items delivered separately, the period runs from receipt of the last item.

For further information on how to exercise your right of withdrawal, you can contact us using the contact form on the website www.motoblouz.fr or by calling us on 03.21.43.33.04.
If you exercise your right of withdrawal, we will reimburse the sums paid, including the cost of delivery:- at the latest within 14 days of the date on which we are informed of your decision to withdraw, although this date may be deferred until receipt of the returned item(s) or proof of shipment, whichever comes first;- by the same means of payment as the one used at the time of the order, unless another means of reimbursement has been agreed between the parties.
In the event of full or partial payment of the order using the Illicado card, this card will be re-credited for reimbursement purposes for an amount identical to that paid in this form at the time the order was placed.
Please note that if you have chosen a delivery method that is more expensive than the standard delivery method, the delivery costs will be reimbursed within the limit of the cost of standard delivery.
You are obliged to return the item(s) within 14 days of being informed of your decision to withdraw from the contract. You may return the item(s) directly to any MOTOBLOUZ store during normal opening hours.
9.1 When can I return an item?
Return the item free of charge for 730 days (2 years) following receipt of the package.
Return 14 days at your expense for items listed in point 9.3 of the GCS following receipt of the parcel (return to be addressed to Motoblouz: 72 Rue Elie Cartan 62220 Carvin).
9.2 How do I return an item?
Return the item in the carton in which it was sent to you, or in an identical carton (reinforced, same size) if the first carton has been damaged.
- Please note that commercial packaging is not suitable for transporting goods.
In order to preserve the item's original box, it must be returned in an over-carton as when originally sent.
9.3 Conditions for your return to be accepted?
To guarantee acceptance of your return, the product must be :
- Brand new and perfectly intact, without any trace of use.
- In its original, undamaged packaging.
- Accompanied by all accessories, labels, instructions and covers.
- For helmets, the reflective labels must not be stuck and the protective film of the screen must still be present.
No returns will be accepted if the items returned have been visibly used or damaged by you, and if such use or damage renders the items unfit for sale. In the case of new items with a defect on receipt, the return request must be made within 30 days of receipt. Otherwise, an after-sales opening will be made on the product when it is received at our premises. If a defect appears after use, an After-Sales Service procedure is possible within the framework of the product warranty (see After-Sales Service section).
Please note: Our After-Sales Service reserves the right to refuse a return if one of the conditions is not met, in which case the parcel will be returned directly to you.
- Exceptions.
For reasons of hygiene and safety, the customer cannot exercise his right of withdrawal for the following items and therefore cannot benefit from the return conditions:
Underwear, socks, Warmcore.
Caps and hats
Arbors
Unsealed cleaning products: aerosols, sprays, cleaning wipes, oils and greases
- Incorrect return / return of the wrong product.
The customer must return to us the product purchased on the www.motoblouz.com website for which he/she has exercised his/her right of retraction, in compliance with the acceptance conditions set out in the GCS (Cf. GCS 9.3 Conditions for your return to be accepted).
If the customer returns a product that does not meet the acceptance criteria stated or if he does not return the correct product, Motoblouz will send him an e-mail inviting him to contact us to arrange for the return to a relay point, at Motoblouz's expense.
If the customer does not accept the return, the parcel will automatically be returned to us by our carrier. Upon receipt, we will inform the customer who will have a period of 2 (two) months from the date of the e-mail to pay for the return shipment.
If the customer wishes Motoblouz to proceed with a new shipment, the cost of transport will be invoiced to the customer prior to shipment.
After this two-month period, Motoblouz will consider itself the owner within the meaning of article 2276, paragraph 1 of the French Civil Code, which states: "In the case of movable property, possession is equivalent to title", and reserves the right to destroy the goods. Motoblouz cannot be held responsible for this destruction.
9.4 How to make your return request?
Find in your order history the one concerning the item in question (it must be less than 2 years old). You can exchange your product with another, opt for a credit note or have it refunded. The process will be explained step by step, but be sure to print out the summary to enclose with your parcel.
- 9.4.1 If you live in metropolitan France, Belgium or Luxembourg, please also print out the delivery note (which you will also receive by e-mail), the cost of which is paid by Motoblouz. The parcel will be delivered to the Mondial Relay point of your choice. Please allow an average of 6 to 8 working days (from the date of delivery) for the parcel to reach us and for us to process your request (replacement, credit note or refund).
- 9.4.2 If you do not live in metropolitan France, Belgium or Luxembourg, you may return the parcel to us by the carrier of your choice (the shipment will be at your expense). You will receive an email confirming that your return has been processed. When returning your parcel by your own means, you must specify on the customs document that it is a return of goods, otherwise customs duties and taxes will be charged to you on receipt of the parcel at our premises. In the case of an exchange outside the European Union, the customs authorities may require you to pay the duties and taxes again on receipt of your exchange.
- 9.4.3. You can also return your products to us by visiting Le Shop Motoblouz, 72 rue Elie Cartan, 62220 Carvin and Le Shop de Seclin. To do this, go to your customer area to specify the desired return method, or go directly to Le Shop so that our advisor can proceed with the return. Please do not send your products to this address.
- 9.4.4. You can also send us by post this form or a statement clearly expressing your wish to exercise your right of withdrawal
9.5 Exceptions
The standard return period of 730 days from receipt of the product may be waived in certain circumstances, in particular for specific commercial operations such as competitions, special promotions or one-off offers, etc. The specific conditions applicable to these operations, including the specific return period, will be specified in the documents governing the operation concerned (for example: product sheet, competition rules, promotional poster for the operation, etc.). In the absence of any mention to the contrary in these documents, the standard return period applies.
10.1 Commercial warranty
The products sold are covered by a commercial warranty designed to guarantee their conformity and to ensure reimbursement of the purchase price, replacement or repair of the goods. It does not cover defects caused by abnormal or faulty use or resulting from a cause unrelated to the intrinsic qualities of the products, or defects mentioned on the product sheet in the case of "second choice/recondonned" products.
Information concerning any commercial warranties relating to the products and services offered for sale (in particular the content of the warranty, the terms and conditions of its implementation, its price, its duration, its territorial scope, as well as the name and address of the guarantor depending on the products, services and brands concerned) is brought to the customer's attention, where applicable, on the sheet for each product and service in the online sales area.
10.2 Legal warranty
Independently of the commercial warranty described above, products are covered by the legal warranty of conformity defined in articles L.217-4 et seq. of the French Consumer Code, and by the warranty for hidden defects defined in articles 1641 to 1649 of the French Civil Code.
When acting under the legal warranty of conformity :
- you have a period of two (2) years from delivery of the goods to take action;
- you may choose between repairing or replacing the good, subject to the cost conditions stipulated in article L. 217-9 of the French Consumer Code;
- you do not have to prove the existence of a lack of conformity for a period of twenty-four (24) months following delivery of the goods (except for second-hand goods).
You may decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code. In this case, you may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the said Code.
Article L.211-4 of the French Consumer Code
"The seller is required to deliver goods in conformity with the contract, and is liable for any defects in conformity existing at the time of delivery.
He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility."
Article L.211-5 of the French Consumer Code
"To conform to the contract, the goods must:
1°/ Be fit for the purpose normally expected of similar goods and, where applicable :
- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- have the qualities that a purchaser may legitimately expect, having regard to public statements made by the seller, the producer or his representative, particularly in advertising or labelling.
2°/ Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter."
Article L.211-12 of the French Consumer Code
"Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.
Article L.211-16 of the French Consumer Code
When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the date of the purchaser's request for intervention, or from the date the item in question is made available for repair, if the item is made available after the request for intervention.
Article 1641 of the French Civil Code
"The seller is liable for any hidden defects in the item sold which render it unsuitable for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.
Article 1648 of the French Civil Code
"The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
Therefore, when the customer brings an action under the legal warranty of conformity as defined by the aforementioned provisions of the French Consumer Code, he :
- has a period of two years from the date of delivery of the product to take action;
- may choose between repairing or replacing the product, subject to the cost conditions stipulated in article L. 211-9 of the French Consumer Code;
- is exempted from proving the existence of the product's lack of conformity during the six months following delivery of the product. This period will be extended to twenty-four months from March 18, 2016.
In any event, the legal warranty of conformity applies independently of any commercial warranty granted by Motoblouz.com on the product(s) ordered.
Finally, the customer may decide to invoke the warranty against hidden defects of the item sold, as defined in article 1641 of the French Civil Code. In this case, the customer may choose either to cancel the sale or to reduce the purchase price in accordance with article 1644 of the French Civil Code.
At any time, "You have the right to access, modify, rectify and delete data concerning you (art. 34 of the French Data Protection Act of January 6, 1978).
